What are patents?

Patent is an right which are exclusive  granted by a country to the owner of an invention to stop other people from making, offering to sale, selling, using or importing his patent invention. If any third party want to use his invention or he want to make, use, import, manufacture or market the invention , then he cannot perform all thing without the consent of the patent holder.

There is nothing like a global patent or a world patent. The right of patent is territorial in nature and inventors or their assignees will have to apply or prosecute the patent application  in the countries of their interest.

Inventions which are patentable In India

Any inventions for which patent is granted must follow three important points:
  1. Patent should be novel: Novelty means it has not been disclosed in the public through any type of publication before filing a patent application in respect of the invention.
  2. Patent should be non-obvious and inventive step is used.
  3. Patent should be useful and industrially applicable.

Inventions - Not Patentable In India

  1. An invention which is frivolous. 
  2. Mere discovery of scientific principle.
  3. The mere discovery of a new form of a known substance which does not result in the enhancement of the efficacy of that substance.
  4. Method of agriculture or horticulture
  5. A presentation of information
  6. Topography of integrated circuits.
  7. A methematical or business method or a computer programme per se or algorithms.
  8. Any process for the medicinal , surgical, curative, prophylactic, diagnostic, therapeutic or other treatment of human beings.
